다음 날 밤, 마감이 끝난 시각.
다니엘이 한결을 오피스로 불렀다.
원목 책상 위에는 평소 보던 레시피나 리포트가 아니라 두툼한 서류 봉투 하나가 놓여 있었다.
"이게 뭐예요?"
"열어 봐."
한결이 봉투를 열어 속장을 꺼냈다. 첫 장을 넘긴 순간 눈이 크게 벌어졌다.

"이거…… 언제 준비했어요?"

"안 열어 봐. 뒷장은 내가 따로 뺄 거야."
"3조가 뭐예요, 3조가. 벌칙 내용을 갑이 정한다니."
"불만 있나."
"불만 많은데요."
다니엘이 낮게 웃었다. 오피스 안의 공기가 처음으로 가벼워졌다.
한결도 웃었다.

한결이 종이를 책상 위에 내려놓았다.
"한국어 우대는 뭐예요. 소스 파트에 한국어가 왜 필요해요."
"한결."
"이거 나 뽑으려고 쓴 공고잖아요."
다니엘이 팔짱을 풀었다.
"당연하지. 널 지명하는 서류니까."
"그럼 28일 동안 지원하는 사람들은 뭐가 돼요?"
"……"
"처음부터 뽑힐 수 없는 자리에 지원하는 거잖아요. 그거 기록으로 남는 거고요."
한결의 목소리는 높지 않았다. 오히려 낮았다.
"이거, 기록을 만드는 거예요. 사실이 아닌 걸로."
"업계에서 다 하는 거야."
다니엘이 말했다.
"직무 기술서는 원래 실제 필요에 맞춰 쓰는 거고, 네가 그 필요에 맞는 사람인 게 왜 문제지."
"그럼 하나만 물을게요."
한결이 고개를 들었다.
"내가 그 자리에 정말 맞는 사람이면, 왜 조건을 나한테 맞춰서 썼어요?"
다니엘이 대답하지 않았다.
"맞는 사람이면 그냥 공고 내고 뽑으면 되잖아요. 다른 지원자 다 받고, 그중에 내가 제일 나으면 그때 지명하면 되잖아요."
"떨어질 수도 있으니까."
"……"
"본사 심사는 서류로만 봐. 네 경력은 한국 파인다이닝 5년인데 증빙이 부실해. 학위도 딱 걸치는 수준이고. 다른 지원자 중에 유럽 경력에 자격증까지 있는 애가 오면 나는 널 못 뽑아."
다니엘이 한 걸음 다가왔다.
"그러니까 내가 미리 조건을 좁힌 거야. 널 지키려고."
한결은 그 문장을 들으면서, 사흘 전 지하 펍의 소음을 떠올렸다.
*근데 다니엘이 그걸 덮었어. 자기가 지시한 걸로 기록을 바꿨어.*
"다니엘."
"응."
"4년 전에 정우한테도 이렇게 했어요?"
다니엘의 얼굴에서 표정이 사라졌다.
방 안이 오래 조용했다.
다니엘은 움직이지 않았다. 한결도 움직이지 않았다.
"누구한테 들었어."
"그게 중요해요?"
"누구한테 들었냐고."
"리암이요."
다니엘이 짧게 숨을 뱉었다. 웃음도 화도 아닌 소리였다.
"그 자식이."
"리암 탓하지 마요."
한결이 서류를 두 손으로 정리했다.
"그리고 정우가 누군지는 나한테 다니엘이 말했어야죠. 리암이 아니라."
"……"
"내가 물어보지 않은 것도 맞아요. 그건 내 잘못이고요."
한결이 서류를 책상 위에 반듯하게 내려놓았다.
"근데 지금은 물어야겠어요. 그 사람, 왜 나갔어요?"
다니엘이 창 쪽으로 시선을 돌렸다.
"실수를 덮어 줬어."
"그거 말고요. 그다음이요."
"……"
"그다음에 주방 사람들이 그 사람을 뭐라고 불렀는지 물어보는 거예요."
다니엘의 턱선에 힘이 들어갔다.
한결은 대답을 기다리지 않았다.
"나 그거 알아요. 이미 들었어요. 그러니까 지금 다니엘이 나한테 이 서류를 주면요."
한결이 펜을 집어 들었다. 그리고 다시 내려놓았다.
"나는 여기서 요리사가 아니게 돼요."
"한결."
"이 공고가 28일 동안 걸리면, 주방 사람들도 그걸 봐요. 조건 읽어 보면 다들 알아요. 시라즈랑 한국어."
한결의 목소리가 조금 흔들렸다. 그래도 끊지 않았다.
"그럼 내가 지금까지 낸 접시들은 전부, 셰프가 봐줘서 나간 게 돼요. 오디트 A+도요."
"그건……"
"내 이름이 처음으로 본사 기록에 올라간 날이었어요. 그거 그렇게 만들기 싫어요."
한결이 서류 봉투를 다니엘 쪽으로 밀었다.
"이거, 서명 안 할게요."
"……뭐?"
"공고 조건 다시 쓰세요. 나한테 맞추지 말고, 이 자리에 진짜로 필요한 걸로요."
"그러면 네가 떨어질 수도 있어."
"알아요."
한결이 고개를 들었다.
"그럼 떨어지는 거죠."
다니엘이 그를 봤다. 사흘 전 밤에 사과했던 눈이었다.
"한 달밖에 안 남았어."
"압니다."
"떨어지면 넌 한국으로 돌아가."
"그것도 압니다."
한결이 문 쪽으로 걸어갔다. 그리고 손잡이를 잡은 채 멈췄다.
"다니엘."
"……"
"나 여기 남고 싶어요. 진짜로요."
한결이 돌아보지 않고 말했다.
"근데 남는 방법이 그거 하나면, 남아도 내가 아니에요."
문이 닫혔다.
책상 위에는 서명란이 비어 있는 서류와, 맨 뒷장에 끼워져 있던 종이 한 장이 남았다.
**3조. 벌칙의 내용은 갑이 정한다.**
다니엘은 그 문장을 오래 내려다봤다.
웃기려고 쓴 문장이었다. 세 시간 전에는 분명히 그랬다.

On the wooden desk there was no recipe and no report, only one thick envelope of papers.
"What is this?"
"Open it."
Hangyeol opened the envelope and drew out the pages. His eyes went wide at the first one.

It was a nomination application in AURA Melbourne's name. The business sponsor approval number was already stamped across the top. The job description, the salary schedule, the list of required work evidence — everything was in order.
Hangyeol's fingertips trembled.
The **occupation** on the form was Chef. Not Cook, Chef. It was the one that could lead to permanent residency later.
"This... when did you prepare this?"
"Before you started worrying about your visa."
Daniel leaned back against the desk, folded his arms, and looked down at him.
"You'd better not even think about running from my kitchen."
Hangyeol let his breath out and was about to close the file.
"Look at the last page too, Han."
Hangyeol lifted the final sheet.
What sat there was not an official document but a single page Daniel had printed himself.

Hangyeol held the paper up and looked up at him. The corners of Hangyeol's mouth shook with the laugh which he was holding back.
"How can you put this in the envelope? What if head office opens it?"
"They won't. I'll pull the last page out myself."
"Article 3, what is Article 3. The penalty is whatever Party A decides?"
"Any complaints?"
"Plenty."
Daniel gave a low laugh. For the first time the air in the office grew lighter.
Hangyeol laughed too.
*Party A decides.* It was a line written to be funny. It stayed that way until it came back to Daniel about three hours later.
Hangyeol was squaring the papers when his hand stopped turning them.
There was one item in the middle of the nomination application.
*Labor Market Testing — the position must be advertised on an approved platform for at least 28 days. A record of applicant assessment must be attached.*
"This."
"Yeah."
"So the position has to go up on a job board."
"It's just a formality. If we don't post it, the nomination is refused."
"For 28 days?"
"That's right."
Hangyeol turned to the next page.
It was the job description.
*Required: experience running a fine-dining sauce section alone. Skill in Korean-style stock technique. Experience adjusting a red wine sauce built on Australian shiraz. Korean-English bilingual kitchen communication preferred.*
Hangyeol read that paragraph twice.
"Daniel."
"Yeah."
"This listing — who could ever see it and apply?"
The office went quiet.
"...What are you talking about."
"Adjusting a red wine sauce built on Australian shiraz. In this kitchen I'm the only one who has ever done it."
Hangyeol set the paper down on the desk.
"And what is that line about Korean being preferred. Why would a sauce section need Korean."
"Han."
"You wrote this listing to pick me."
Daniel unfolded his arms.
"Of course I did. It's the paper that **nominates** you."
"Then what becomes of the **applicants** who apply during those 28 days?"
"..."
"They're applying for a job that could never have gone to them. And that stays on the record."
Hangyeol's voice was not loud. It was low, if anything.
"This is making a record. Out of something that isn't true."
"Everyone in this industry does it."
Daniel said.
"A job description is written to match the real need, and you're the man who matches that need. Why is that a problem."
"Then let me ask one thing."
Hangyeol raised his head.
"If I'm really the right man for that job, why did you write the terms around me?"
Daniel did not answer.
"If I'm the right man, put the listing out and hire me. Take applications from everyone else, and if I come out best, name me then."
"Because you could lose."
"..."
"Head office judges on paper only. Your record is five years in Korean fine dining, and the proof behind it is thin. Your degree only just clears the bar. If someone walks in with European kitchens and **credentials** behind him, I can't pick you."
Daniel took a step closer.
"So I narrowed the terms in advance. To keep you."
As Hangyeol listened to that sentence, he remembered the noise of the basement pub three nights before.
*But Daniel buried it. He changed the record into something he had ordered himself.*
"Daniel."
"Yeah."
"Four years ago, did you do this for Jungwoo too?"
The expression left Daniel's face.
The room stayed quiet for a long time.
Daniel did not move. Hangyeol did not move either.
"Who told you."
"Does that matter?"
"I asked who told you."
"Liam."
Daniel let out a short breath. It was not a laugh and not anger.
"That little idiot."
"Don't blame Liam."
Hangyeol squared the papers with both hands.
"And who Jungwoo was — it should have been you who told me. Not Liam."
"..."
"It's also true that I never asked. That part is my fault."
Hangyeol laid the papers flat on the desk.
"But I have to ask now. Why did he leave?"
Daniel turned his eyes toward the window.
"I covered a mistake for him."
"Not that. What came after."
"..."
"I'm asking what the kitchen called him after that."
Daniel's jaw tightened.
Hangyeol did not wait for the answer.
"I already know that. I've heard it. So if you hand me this paper now."
Hangyeol picked up a pen. Then he set it down again.
"I stop being a cook in this kitchen."
"Han."
"If this listing runs for 28 days, the kitchen reads it too. Anyone who reads the terms will know. The shiraz and the Korean."
Hangyeol's voice shook a little. He did not stop.
"Then every plate I've sent out becomes a plate the chef let through. The A+ audit too."

"That was the day my name went into head office records for the first time. I don't want that day turned into something like that."
Hangyeol pushed the envelope back toward Daniel.
"I'm not signing this."

Daniel looked at him. His eyes were the same eyes that had apologized three nights before.
"You have only one month left."
"I know."
"If you lose, you go back to Korea."
"I know that too."
Hangyeol walked toward the door. Then he stopped with his hand on the handle.
"Daniel."
"..."
"I want to stay here. I really do."
Hangyeol spoke without turning around.
"But if that is the only way to stay, then the man who stays isn't me."
The door closed.
The desk held the file with an empty signature line, and the one page that had been slipped behind the last sheet.

Daniel looked down at that line for a long time.
It was written to be funny. Three hours earlier it certainly had been.
He picked up the paper and folded it in half. Then he pressed the fold once with his finger, opened it back out, and set it on the desk.
